Who in Kentucky Is Entitled for Workers’ Compensation?

In Kentucky, the majority of employers are mandated to either obtain their self-insurance or carry workers’ compensation insurance. A notification identifying the name of the workers’ compensation insurance carrier must also be posted by the employer.

Available benefits for injured workers

Depending on the type of accident, employees who are hurt at work may be eligible for several benefits under workers’ compensation regulations. These could consist of:

  • Medical benefits
  • Permanent partial disability benefits
  • Permanent total disability benefits
  • Vocational rehabilitation benefits
  • Wage reimbursement benefits

How to File a Workers’ Compensation Claim

Step 1

Go to the hospital or doctor as soon as possible following your accident to receive medical attention, and inform your manager or supervisor of what happened. It is your responsibility to notify your employer in writing of your injuries within 30 days of the incident. Fill out Form C-3 (Employee Claim) and email it to your local Workers’ Compensation District Office within two years of the accident or injury.

Step 2

Your employer has ten days from the time they receive notification of the accident or injury to file a Form C-2 (Employer’s Report of Work-Related Illness or Injury) with the Board and their insurance provider. Your rights under these regulations must be outlined in writing by the insurance adjuster to you within 14 days of receiving the Employer’s Report. An insurance company may begin disbursing compensation after 18 days of receiving the Employer’s Report if the claim is not accepted or rejected within 7 days.

Step 3

You can anticipate receiving payments directly from the insurance company every two weeks after your Worker’s Compensation claim has been approved. The Board must receive progress reports from your healthcare practitioner (doctor) every forty-five days. Your insurance company will determine whether receiving rehabilitation treatment is necessary if, even after 12 weeks, you are still in the process of healing.
