Bill Dick, K.C.

I have extensive experience representing plaintiffs in serious, complex personal injury claims, including medical malpractice and insurance disputes both at trial and on appeal. I also have expertise in handling complex commercial litigation, construction law disputes, and representing plaintiffs in class action lawsuits. In addition to my courtroom experience, I have many years of expertise advocating for clients involved in mediation and arbitration. I was honoured to have been appointed a Queen’s Counsel in December 2018 (King’s Counsel as of September 8, 2022). My effective representation of clients includes taking cases to trial for people who have sustained brain injuries and spinal cord injuries. Whether my clients need help negotiating a compensation claim or taking the matter forward to trial, my knowledge and ability as an advocate have produced positive outcomes for my clients. I work out of the firm’s Vernon office along with paralegal Cathy Davies.

I have over 20 years of experience representing clients of all ages who have been injured. My practice focuses on helping people who have been injured as a result of malpractice by doctors, hospitals, nurses, or other allied healthcare professionals, such as midwives, chiropractors, dentists, naturopaths, pharmacists, psychologists, counsellors, and medical spa aestheticians. In addition to malpractice, I have experience helping people who have been injured in car accidents, through assaults, and by defective products. I also represent the families of people killed through malpractice or accidents. I am based at Murphy Battista LLP’s Kelowna office but travel throughout the province for my clients.

J. Scott Stanley

I grew up in Saskatchewan and was the first member of my family to go to university. I went to law school not knowing what type of lawyer I wanted to be. I simply wanted to help people. I started my career defending institutional defendants (insurance companies, corporations, government, etc.). While I excelled as a defence lawyer (especially in trial work), the reality is that the party with the best lawyer will almost always win. I did not like beating the very people I wanted to help when I went to law school. Many years ago, I stopped working for institutional defendants and joined Murphy Battista LLP where I only represent regular people or small companies who have claims against institutional defendants. I eventually became a partner at Murphy Battista LLP – the first to join the original two partners. I know firsthand the tremendous level of resources and pressure that institutional defendants direct at regular people. I also know that the only thing they respond to is fear of losing at trial which is why I devoted myself to becoming an effective trial lawyer. I now use the things that I learned as a defence lawyer to help my clients win their cases. I prepare every case for trial because this is the only way my clients will be taken seriously during settlement negotiations. If we do not settle, then I am already prepared for trial. I am grateful to all my clients who have entrusted me with their most important legal issues. This trust has allowed me to conduct and win some of the largest trials in the history of B.C.

I have been a trial lawyer my entire career. As a prosecutor ensuring the safety of the community, or as a defence lawyer protecting the Charter Rights of individuals, fairness and respect are at the core of my belief system. These principles have guided my practice over the last 28 years. Having been diagnosed with Tourette Syndrome at a young age, I have some understanding of the challenges that those with disabilities face. With the assistance of the Speakers Bureau of Canada, I share my experience with others outlining the importance of neurodiversity and inclusion in the workplace. I maintain a practice in both British Columbia and Newfoundland & Labrador, my home province, helping those who have suffered at the hands of others. I represent clients who have been injured in motor vehicle accidents and those who have been hurt in slips and falls. My clients include individuals who have experienced medical malpractice at the hands of their doctors and others who are survivors of sexual assault.
